Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the website operated by Found Your Place (“Company,” “we,” “our,” or “us”). By accessing or using this website, you agree to be bound by these Terms. If you do not agree, you must not use the website or services.

1. Eligibility and Use

You must be at least 18 years old to use this website. You agree to use the website and services only for lawful purposes and in accordance with these Terms. You may not use the website:

  • For any unlawful purpose, including fraud or misrepresentation
  • To interfere with or disrupt the website’s operation
  • To collect information about others without consent
  • To infringe upon our rights or the rights of others

2. User Accounts

If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities under your account. We may suspend or terminate your account at our discretion for violations of these Terms.

3. Property Listings and Availability

Property listings are provided by third parties such as landlords, property owners, housing agencies, or other external partners. Found Your Place does not guarantee the accuracy, completeness, or availability of any listing. We are not a real estate broker, agent, or landlord, and we are not a party to any lease or housing agreement between users and third parties.

4. Tenant Applications and Matching

We facilitate introductions between housing applicants and property providers but do not guarantee placement or housing eligibility. Final decisions are made by landlords, property owners, or agencies, not by Found Your Place.

5. Inspections and Pre-Clearance

Inspections are conducted or coordinated by external agencies, landlords, or housing authorities. We are not responsible for inspection scheduling, delays, cancellations, or outcomes beyond our control.

6. Third-Party Services and Links

The website may contain links to third-party sites and services. We are not responsible for the content, accuracy, or practices of any third parties. Your interactions with third parties are solely between you and those parties.

7. No Legal, Financial, or Housing Advice

Found Your Place provides general informational support only. We do not provide legal advice, financial advice, or official housing determinations. Users should consult appropriate professionals for legal, financial, or housing guidance.

8. Intellectual Property

All content on the website—including text, graphics, logos, and design—is owned by or licensed to Found Your Place and protected by intellectual property laws. You may not copy, distribute, modify, or use any content without our prior written consent.

9. User Representations and Compliance

By using the website or services, you represent and warrant that:

  • All information you provide is true, accurate, and complete
  • You will comply with all applicable laws and regulations
  • You have the legal authority to enter into binding agreements
  • You will not use the website for any unlawful or fraudulent purpose

10. Limitation of Liability; Directors and Officers Protection; Indemnification

To the maximum extent permitted by law, Found Your Place, its officers, directors, employees, agents, affiliates, licensors, and service providers (collectively, “Released Parties”) shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising from:



(a) your use of or inability to use the website or services

(b) third-party conduct or content

(c) content obtained through the website

(d) unauthorized access to or alteration of your transmissions or data

You agree that no officer, director, employee, agent, affiliate, or representative of Found Your Place shall have any personal liability arising out of or relating to the website, services, or these Terms. You waive any right to bring claims against such individuals in their personal capacities.

You agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of your violation of these Terms or use of the website.

11. Force Majeure

.We are not liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, acts of God, government actions, wars, terrorism, pandemics, labor disputes, or power or internet outages (“Force Majeure Events”). Our obligations will be suspended during such events and resume when performance becomes possible.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

13. Dispute Resolution; Binding Arbitration; Legal Fees; No Class Claims

Any dispute, claim, or controversy arising out of or relating to these Terms, your use or continued use of the website, any communications between you and Found Your Place (including but not limited to email, text messages, or phone calls), or any other arrangement or understanding between you and Found Your Place (collectively, “Potential Claims”) shall be finally resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules then in effect. Judgment on the award rendered by the arbitrator may be entered in any court of competent jurisdiction.

The arbitration shall be conducted by a single neutral arbitrator in the City of New York, State of New York, who shall have relevant professional expertise. The arbitrator shall issue a reasoned award, including findings of fact and conclusions of law. All arbitration proceedings, materials, evidence, and awards shall be strictly confidential and shall not be disclosed by either party except as necessary to enforce the arbitration award or as required by law. Any submission of materials to a court for enforcement shall be made under seal.

You and Found Your Place expressly waive any right to a jury trial with respect to any Potential Claims. No claim or arbitration under these Terms shall be joined to any other claim or arbitration, and no class arbitration proceedings shall be permitted. The arbitration shall be final and binding on both parties.

If the party initiating the arbitration does not prevail on a material portion of its claims, the initiating party shall pay the responding party’s expenses, costs, and fees, including reasonable attorneys’ fees and the costs of any counterclaims asserted.

Notwithstanding the foregoing, either party may apply to the state or federal courts located in the City and State of New York for injunctive relief or enforcement of this arbitration provision without breaching it. The parties consent to the exclusive jurisdiction and venue of such courts for that limited purpose and waive any objection based on improper venue or inconvenient forum.

14. Equitable Relief

You acknowledge and agree that it would be inadequate or impossible to calculate the damages that Found Your Place would suffer from a breach or threatened breach of certain obligations under these Terms, including but not limited to obligations relating to intellectual property, confidentiality, misuse of the website, or unlawful interference with Found Your Place’s operations.

Accordingly, Found Your Place shall have the right to seek immediate injunctive relief or specific performance to prevent or remedy any breach or threatened breach of these Terms, without the need to post any bond or other security. Such remedies shall be in addition to, and not in limitation of, any other remedies available to Found Your Place in law or equity.

If Found Your Place prevails in any action or proceeding for equitable relief, it shall be entitled to recover from you all expenses, costs, and fees, including reasonable attorneys’ fees. For the purpose of such proceedings, you consent to the personal and exclusive jurisdiction and venue of the state and federal courts sitting in the City and State of New York, and waive any objections based on venue or forum.

15. Timely Filing of Claims

To the fullest extent permitted by law, you agree that any cause of action or claim arising out of or relating to your use of the website, these Terms, or any communications or arrangements with Found Your Place must be filed within one (1) year after such claim or cause of action arose or is alleged to have arisen, or it shall be permanently barred, regardless of any statute or law to the contrary.

16. Notices (Certified Mail Only)

All notices required under these Terms must be in writing and sent exclusively by United States Postal Service certified mail, return receipt requested, to:

Notices are deemed effective on the date indicated on the return receipt. Notices sent by other methods, including email or courier, are not valid.

17. Modification and Review of Terms

Found Your Place may revise and update these Terms at any time by posting the revised version on the website. All changes take effect immediately upon posting and apply to all use thereafter. It is your responsibility to review these Terms periodically to stay informed of changes. Your continued use of the website constitutes acceptance of any updated Terms.

18. Assignment

You may not assign, sell, or transfer any of your rights or obligations under these Terms without the prior written consent of Found Your Place, which may be granted or withheld in our sole discretion.
Found Your Place may assign or transfer these Terms automatically, without notice, to any affiliate, successor, or third party, including without limitation in connection with any merger, acquisition, corporate reorganization, bankruptcy, or sale of assets. This includes the right to transfer or share some or all of our assets, including personal information we have collected, with any subsidiary, parent company, joint venture, entity under common control, or potential acquirer. In each such event, these Terms shall inure to the benefit of Found Your Place’s successors, assigns, and licensees.

19. Non-Waiver

Our failure to enforce any provision shall not be deemed a waiver of our rights to enforce it later.

20. Entire Agreement; Severability

These Terms constitute the entire agreement between you and Found Your Place regarding your use of the website. If any provision is held invalid, the remaining provisions remain in full force and effect.

21. Survival

All provisions that by their nature should survive termination—including intellectual property rights, indemnification, limitation of liability, arbitration, governing law, and notices—shall survive termination or expiration of these Terms.
